Doctors don't have to tell you or your relatives what they will do to your body during an organ harvest operation because you'll be dead, with no legal rights.
The last time I renewed my driver's license, the clerk at the DMV asked if she should check me off as an organ donor. I said no. She looked at me and asked again. I said, "No. Just check the box that says, 'I am a heartless, selfish bastard.'"
Becoming an organ donor seems like a win-win situation. Some 3.3 people on the transplant waiting list will have their lives extended by your gift (3.3 is the average yield of solid organs per donor). You're a hero, and at no real cost, apparently.
But what are you giving up when you check the donor box on your license? Your organs, of course—but much more. You're also giving up your right to informed consent. Doctors don't have to tell you or your relatives what they will do to your body during an organ harvest operation because you'll be dead, with no legal rights.
The most likely donors are victims of head trauma (from, say, a car or motorcycle accident), spontaneous bleeding in the head, or an aneurysm—patients who can be ruled dead based on brain-death criteria. But brain deaths are estimated to be just around 1% of the total. Everyone else dies from failure of the heart, circulation and breathing, which leads the organs to deteriorate quickly.
The current criteria on brain death were set by a Harvard Medical School committee in 1968, at a time when organ transplantation was making great strides. In 1981, the Uniform Determination of Death Act made brain death a legal form of death in all 50 states.
The exam for brain death is simple. A doctor splashes ice water in your ears (to look for shivering in the eyes), pokes your eyes with a cotton swab and checks for any gag reflex, among other rudimentary tests. It takes less time than a standard eye exam. Finally, in what's called the apnea test, the ventilator is disconnected to see if you can breathe unassisted. If not, you are brain dead. (Some or all of the above tests are repeated hours later for confirmation.)
Here's the weird part. If you fail the apnea test, your respirator is reconnected. You will begin to breathe again, your heart pumping blood, keeping the organs fresh. Doctors like to say that, at this point, the "person" has departed the body. You will now be called a BHC, or beating-heart cadaver.
Still, you will have more in common biologically with a living person than with a person whose heart has stopped. Your vital organs will function, you'll maintain your body temperature, and your wounds will continue to heal. You can still get bedsores, have heart attacks and get fever from infections.
"I like my dead people cold, stiff, gray and not breathing," says Dr. Michael A. DeVita of the University of Pittsburgh Medical Center. "The brain dead are warm, pink and breathing."
You might also be emitting brainwaves. Most people are surprised to learn that many people who are declared brain dead are never actually tested for higher-brain activity. The 1968 Harvard committee recommended that doctors use electroencephalography (EEG) to make sure the patient has flat brain waves. Today's tests concentrate on the stalk-like brain stem, in charge of basics such as breathing, sleeping and waking. The EEG would alert doctors if the cortex, the thinking part of your brain, is still active.
But various researchers decided that this test was unnecessary, so it was eliminated from the mandatory criteria in 1971. They reasoned that, if the brain stem is dead, the higher centers of the brain are also probably dead.
But in at least two studies before the 1981 Uniform Determination of Death Act, some "brain-dead" patients were found to be emitting brain waves. One, from the National Institute of Neurological Disorders and Stroke in the 1970s, found that out of 503 patients who met the usual criteria of brain death, 17 showed activity in an EEG.
Even some of the sharpest critics of the brain-death criteria argue that there is no possibility that donors will be in pain during the harvesting of their organs. One, Robert Truog, professor of medical ethics, anesthesia and pediatrics at Harvard Medical School, compared the topic of pain in an organ donor to an argument over "whether it is OK to kick a rock."
But BHCs—who don't receive anesthetics during an organ harvest operation—react to the scalpel like inadequately anesthetized live patients, exhibiting high blood pressure and sometimes soaring heart rates. Doctors say these are simply reflexes.
What if there is sound evidence that you are alive after being declared brain dead? In a 1999 article in the peer-reviewed journal Anesthesiology, Gail A. Van Norman, a professor of anesthesiology at the University of Washington, reported a case in which a 30-year-old patient with severe head trauma began breathing spontaneously after being declared brain dead. The physicians said that, because there was no chance of recovery, he could still be considered dead. The harvest proceeded over the objections of the anesthesiologist, who saw the donor move, and then react to the scalpel with hypertension.
Organ transplantation—from procurement of organs to transplant to the first year of postoperative care—is a $20 billion per year business. Average recipients are charged $750,000 for a transplant, and at an average 3.3 organs, that is more than $2 million per body. Neither donors nor their families can be paid for organs.
It is possible that not being a donor on your license can give you more bargaining power. If you leave instructions with your next of kin, they can perhaps negotiate a better deal. Instead of just the usual icewater-in-the-ears, why not ask for a blood-flow study to make sure your cortex is truly out of commission?
And how about some anesthetic? Although he doesn't believe the brain dead feel pain, Dr. Truog has used two light anesthetics, high-dose fentanyl and sufentanil, which won't harm organs, to quell high blood pressure or heart rate during harvesting operations. "If it were my family," he said, "I'd request them."

Toras Purim 5772: BaChatzar Ginas Bissan


When Purim comes around, I try to find some phrase in the Megillah that captures an essential aspect of the day and its simcha. See, for example, the series on Chur, Karpas u'Techeles, beginning with http://rygb.blogspot.com/2008/03/toras-purim-5768-chur-karpas-utecheles.html.

This year, the phrase is BaChatzar Ginas Bissan (בחצר גנת ביתן), which appears in Esther1:5 as the places in which the seven-day party for the local populace of Shushan took place. A chatzer then figures prominently as the place where Esther stood to attract the king's attention, at the beginning of the fifth perek, and Haman hangs around there at the beginning of the sixth perek to try to get Mordechai hung. The Ginas HaBissan figures prominently in the middle of the seventh perek, as the place where the king goes when Esther tells him about Haman, and the place from whence he returns to have Haman hung.

Although Rashi seems to understand a ginah to be a vegetable garden and a bissan to be a grove of trees, we will go here with the Gra, who understands the chatzer to be an outer courtyard before the ginah – which is a pleasure garden – within which is a bissan, a royal pavilion. The Gra understands these three places as metaphors, respectively, for this world; for the Gan Eden on High, in which Hashem interacts with the tzaddikim; and for the pavilion of Hashem (מחיצתו של הקב”ה) in which only the greatest tzaddikim are to be found.

Let us take a slightly different approach.

The three words, can be broken down as follows: חץ-ר, גן-ת, בית-ן – divide, or separate the reish; the garden of the taf; the house of the nun.

In other words: Separate yourself from potentially bad surroundings; enter the garden of knowledge; and then, go into the pavilion of understanding.

There are corresponding pesukim to bear out these ideas.

The two-hundredth pasuk in the Torah is the command to Noah to leave the ark: צא מן התבה. In the previous pasuk we are forewarned that this is no easy matter: The command is introduced with וידבר אלקים. This is the first time Hashem communicates with man in the form of dibbur – which we know is a “tough” mode of expression, and it is with the middah of Elokim – the Middas HaDin – with which the communication is made. And Bereishis Rabba (34:2) explains (albeit somewhat cryptically, see the mefarshim there): ה' צדיק יבחן, זה נח, שנאמר צא מן התבה. The time in the ark was a time of suspended judgment, of great chesed for those borne within it. No more – לפתח חטאת רובץ – the yetzer ho'ra is waiting on the threshold to test the tzaddik (who will indeed stumble in planting a vineyard). A person must put gedarim up around himself to set himself off from temptation – those fences create the chatzer.

Once separated from the evil, סור מרע, a person can begin the עשה טוב. The garden of knowledge culminates in the letter taf, four hundred. This brings to mind, of course, the Gemara in Bava Basra where an Amora is said to have written 400 Sifrei Torah, where the Gemara clarifies that, in fact, he wrote the pasuk תורה צוה לנו משה four hundred times. This pasuk is the Reishis Chochmah – the first piece of knowledge one is supposed to teach a child – and the four hundred times means perfection – תמימות – in that knowledge. So, in the 399th pasuk in the Torah (Bereishis 17:1), Hashem tells Avram: והיה תמים – you are about to reach a level of perfection – but there is more to come: ואתנה בריתי ביני ובינך וארבה אותך במאד מאד. Bereishis Rabba (49:2) states: כתיב (תהלים כה) סוד ה' ליראיו ובריתו להודיעם איזהו סוד ה' זו מילה שלא גלה אותה מאדם ועד עשרים דור עד שעמד אברהם ונתנה לו שנאמר ואתנה בריתי ביני ובינך א"ל הקב"ה אם תמול תטול סוד ה' מה סוד ה' ס' ששים ו' ששה ד' ארבעה הרי שבעים שבעים אני מעמיד ממך בזכות המילה שנאמר (דברים י) בשבעים נפש ירדו אבותיך מעמיד אני מהן שבעים זקנים שנא' (במדבר יא) אספה לי שבעים איש מזקני ישראל ומעמיד אני מהן משה שהוא הוגה בתורה בשבעים לשון שנאמר (דברים א) הואיל משה באר וגו' בזכות מי בזכות המילה שנאמר סוד ה' ליראיו.

The knowledge of Torah leads one to sod – which is the same Yiras Hashem as the Reishis Chochmah. It could only be properly absorbed – even by Avrohom Avinu – after the Bris, because such knowledge is intertwined with Kedushah. This is the Chochmah of the Eitz HaChaim – in the Gan.

Then one can begin entering the pavilion – the Bayis (on a different, but similar, continuum – that of the Beis HaMikdash – the house of Yaakov that follows the mountain of Avrohom and the field of Yitzchok), and attempt the ascent to the nun – the fifty gates of Binah. And the fiftieth pasuk in the Torah conveys that message, as it is in this pasuk (Bereishis 2:20) that Hashem brings the animals to Adam to name. And, as we know, the name of a thing in Lashon HaKodesh captures its essence. Adam had the capacity of Hisbonenus and achieved the Binah to grasp the essence of every creature: Even more so, Bereishis Rabba (17:4) tells us that Adam named Hashem: א"ר אחא בשעה שבא הקב"ה לבראת את האדם נמלך במלאכי השרת אמר להן נעשה אדם אמרו לו אדם זה מה טיבו אמר להן חכמתו מרובה משלכם הביא לפניהם את הבהמה ואת החיה ואת העוף אמר להם זה מה שמו ולא היו יודעין העבירן לפני אדם אמר לו זה מה שמו אמר זה שור זה חמור זה סוס וזה גמל ואתה מה שמך אמר לו אני נאה להקרא אדם שנבראתי מן האדמה ואני מה שמי א"ל לך נאה להקראות אדני שאתה אדון לכל בריותיך א"ר אחא (ישעיה מב) אני ה' הוא שמי הוא שמי שקרא לי אדם!

But the ascent is a perilous one. The nun is a nun-sofis, which is regarded as רגליה יורדות מות, and which represents nefilah. The Seforim tell us that Haman aspired to the fifty gates of Binah. He even knew where to find the eitz for that ascent – from Noah's ark – the state of illumination (tzohar) that was within the ark. But Haman wanted to enter the Bissan without going through the Chatzer and the Ginah. The סור מרע was not part of his world at all, and the acquisition of Chochmah he attempted to short-circuit by paying: בצל החכמה בצל הכסף. The fifty gates of Binah would be his by “chance!” This too he wanted to acquire through Noah, as Reb Tzadok teaches us (Tzidkas HaTzaddik 83): כמו שיש בקניני העולם הזה פעמים שאדם מוצא מציאה הון רב או זוכה בגורל לאטע"ריע ומתעשר בלא שום יגיעה כך יש גם כן בקניני עולם הבא [הגם שאמרו בפרק קמא דמגילה (ו' ע"ב) לא יגעת ומצאת אל תאמין הא אסקינן שם הני מילי כו', אבל לאוקמי גירסא סייעתא מן שמיא, ובודאי לא קאי רק איגעת ולא מצאת לחוד שהרי מדה טובה מרובה ואם אפשר יגעת ולא מצאת כל שכן דאפשר לא יגעת ומצאת על ידי סייעתא דשמיא] וכענין (בראשית ו' ח') ונח מצא חן בעיני ה' ואמרו ז"ל (בראשית רבה כ"ט ג') הוא מצא אבל הקב"ה לא מצא היינו כי פעמים אדם זוכה בלא שום יגיעה שהוא שמור מן העבירה ונקרא צדיק וזהו מדריגת נח [שמדה כנגד מדה היה שמור מן הפורעניות] ופעמים אדם זוכה להשיג השגות מידיעת השם יתברך ואורו וזהו מציאת ישראל שהקב"ה מצא שבזה מיוחס גם כן המציאה למעלה כי יותר מה שעגל וכו.

This is the old story of Amalek, and Seder shel Mikreh, and the usurpation of Am Yisroel's Reishis. ויש להאריך. But there are no shortcuts, and since Haman never even gets past the Chatzer, he remains Haman Ho'Ra. Indeed, he mocks the milah that is the prerequisite to true Chochmah (ויזנב). So Melech Malchei HaMelachim is comes from the Ginas HaBissan and commands the destruction of the usurper. חצר גנת הביתן in gimatria (1213) is ויתלו את המן על העץ (Esther 7:10)! (It's also נדדה שנת המלך ויאמר להביא, ודוק). All of this is encapsulated in the mitzva of Zachor, which is חצר גנת הביתן in gimatria is also פרשת זכור).

By the way, not at all apropos the ideas above, but since I found the last gimatria via http://www.c2kb.com/gematria/, I also ran עד דלא ידע – which comes out 193 – and is the equivalent of both אני ה' אלקיכם and וחי אחיך עמך – the two purposes of the mitzva (and why, seeing that the second message was not fulfilled, R' Zeira didn't go back again to drink with Rabbah on Purim!).

Addenda

One pasuk in Tanach is the equivalent of חצר גנת הביתן in gimatria:
תהלים פרק סב
(ח) עַל אֱלֹהִים יִשְׁעִי וּכְבוֹדִי צוּר עֻזִּי מַחְסִי בֵּאלֹהִים:
and if one adds the beis to בחצר, one gets the connection between Purim and Chanukah, as בחצר גנת הביתן in gimatria (1215) is מעוז צור ישועתי! (Note the similarity to the pasuk in Tehillim!)
