And the Rabbis ascertained that five [vegetable types] planted in [a patch of] six [tefachim] are not nourished from each other. And from where do we know that what the Rabbis ascertain is significant? As R' Chiya bar Abba said in the name of R' Yochanan: What is that which is written: Do not assail the boundary of your friend [which the ancient ones set out]? Do not assail the boundary that the ancient ones established. What is the meaning of: which the early ones set out? R' Shmuel bar Nachmani said in the name of R' Yonasan: As it is written: These are the sons of Seir the Chorite, inhabitants of the land. Does the entire world inhabitant the sky!? Rather, that they were experts in the settling of the land. As they used to say: This rod's length for olives, this rod's length for grapevines, this rod's length for figs. And "Chorite?” Because they would smell the ground. And "Chivite?” Rav Pappa said: Because they would taste the ground like a snake.
Teshuvos Maharsham1 cites a question concerning a Jew who bought an orchard full of fruit trees that were grafted in manners that rendered them kilayim from a non-Jew. Is the Jew obligated to uproot these trees?
Maharsham first notes that some Rishonim permit a Jew to retain kilayim that he has acquired, but the consensus is that it is forbidden to retain kilayim.2 However, we do not find that a person who does retain kilayim is flogged. Why not?
Maharsham explains why not on the basis of Tosafos3 here, who ask why the Gemara in Chullin indicates that a person who plants kilayim is only flogged once. Why is he not flogged twice, once for the prohibition of planting kilayim itself and another for “assailing the boundary?” Tosafos give two reasons: 1) The prohibition of “assailing the bondary” is primarily directed against theft of one’s neighbor’s land. As such, it is a prohibition that is subject to restitution (return of the land), for which lashes are not imposed; 2) The prohibition of “assailing the bondary” refers to more than one form of forbidden activity. As such, it is a generic prohibition, for which lashes are not imposed either.
But Tosafos only considers the law of a person who plants kilayim. What of a person who retains kilayim? We have seen that most Rishonim forbid the retention of kilayim. The source of this prohibition is this verse: Do not assail the boundary of your friend. Yet, as explained here by Rashi,4 Do not assail the boundary of your neighbor means that it is forbidden for a person to plant adjacent to his friend’s field, as this saps his neighbor’s land’s strength. Does this prohibition relate to retention in your own field?
We see that Tosafos are of the opinion that although the verse focuses on assailing the boundary of your friend, it also pertains to your planting of kilayim within one’s own field. Otherwise, Tosafos might have answered that the Gemara in Chullin concerns planting kilayim in one’s own field, while the prohibition of “assailing the boundary” pertains only to a case in which your planting caused a kilayim problem to affect your friend’s field.
But how does one best one’s one field? On the basis of Rashi’s interpretation, Maharsham explains that in planting kilayim in your own field, and causing different species to deprive each other of nourishment, one is literally “assailing” one’s own field (and just as in the case in which you assail your friend’s field by “stealing” his property you must make restitution, here too you must make “restitution” to your own field by uprooting the kilayim).
On the basis of this definition of the prohibition, Maharsham suggests a distinction between planted kilayim and grafted kilayim: From a botanic perspective, two species planted as kilayim deprive each other of nourishment, but two species grafted together enhance each other’s nourishment. Thus, in retaining grafted trees one is not “assailing” one’s field. On the contrary, one is “supporting” one’s field. Hence, the prohibition to retain kilayim derived from the verse: Do not assail the boundary of your friend is not applicable to grafted kilayim.5
On the basis of this premise, and additional analysis and consideration of the issues involved, Maharsham concludes that the Jew who purchased the orchard need not uproot the grafted trees - but that he should sell them to a non-Jew.6

Wood in a Mikveh

ושל עץ בין מדרסו ובין מגעו טמא
But [a boat] of wood, both its midras and its contact are tamei.
Above (83), we learned that only wooden vessels that can be categorized as resceptacles are susceptible to tumas sheretz [or to other sorts of contact-generated tumah], and that flat wooden objects are not be susceptible to contact-tumah. Here, however, we are taught that a wooden plank that sustains the weight of a person is susceptible to the tumah of midras - i.e., tumah imparted by certain categories of people who are tamei to the objects that support them. Moreover, since the rule is that whatever is susceptible to midras is also susceptible to contact-tumah, such a wooden plank is also susceptible to contact-tumah.
The law is that a woman may not immerse herself in a mikveh that is a vessel distinct from the ground. The Rabbi extended that decree to include immersion in a mikveh, even if it is connected to the ground if the woman stands atop something that is susceptible to tumah. From our Gemara it is derived that a woman may not stand on a plank in a mikveh (even if the mikveh is an unlined lake or pond, and hence, were it not for the plank, she would be standing in the mud), and Shulchan Aruch1 rules accordingly. Moreover, if a mikveh has wooden steps, she may not immerse herself on the steps. Teshuvos HaRashba (cited in Rema ad loc.) adds that this is even the case where the wooden steps are built into the mikveh.
In cases in which some sort of flooring must be made, and it is not feasible to use cement, such as the case of a lake, etc., Sidrei Taharah, cited in Pischei Teshuvah,2 suggests that narrow planks, each of which in itself is too narrow to sustain the weight of a person, should be placed side by side to form a flooring.
What about the walls of a mikveh? Teshuvos Minchas Yitzchak3 notes that all the sources that discuss the issue focus on the floor of a mikveh, not its walls. Citing Ran, he proves from a Gemara that appears in several places in Shas (most recently on Shabbos 65a), that the walls may be made of wood boards. The Gemara in question relates that the father of Shmuel would place mats in the river around the area in which his daughters immersed themselves, so as to hide them from onlookers.4 Mats are susceptible to tumas midras. Hence, were it forbidden to line a mikveh with material that is susceptible to tumas midras, in erecting these mats Shmuel’s father would have been rendering the enclosure unsuitable for immersion! Perforce, the concern is only with the flooring of a mikveh, not with its walls.

קנה כדי לעשות קולמוס
A reed, [the measure of size that makes one who carries it in a public domain liable for violating the prohibition of carrying is] enough to make a pen.
Rema1 cites an opinion that a Sefer Torah must be written with a pen fashioned from a reed, not with a feather quill. Gra2 writes that one of the source upon which this perspective is based is our Gemara, which links the term kulmus, generally used to describe the pen with which a Sefer Torah is written, with reed. Shach3 writes that the custom is not to require that the pen for writing a Sefer Torah be fashioned from a reed, although Dvar Shmuel4 is unsure whether a feather quill from a non-kosher bird may be used.
In a case that came before a Beis Din,5 the family that contracted with a sofer to write a Sefer Torah mehudar [of the finest caliber] on their behalf complained of several procedures that the sofer employed that they felt made the Sefer Torah fall short of being mehudar.
Among their complaints was that although the sofer they hired wrote the letters themselves in the traditional manner, the sofer in turn hired another sofer to put in the tagin (the little “crowns” that adorn the tops of many letters), and that the second sofer used a “rapidograph” (a very fine metal-tipped ink drawing pen) rather than a reed pen or quill to write the tagin. The sofer, for his part, responded that a rapidograph produces nicer and more permanent tagin than a reed pen, and that therefore, the use of the rapidograph was a part of what made this a Sefer Torah mehudar.
In the Beis Din’s ruling, written by Rabbi Avrohom Dov Levin, they cite Rema,6 who writes that it is preferable not to write a Get with a metal-tipped pen because it may engrave, rather than write. Pischei Teshuvah7 explains that this is because it is possible that the indentation in the parchment made by the metal tip will precede the pen’s release of ink. In that case, the indentation is considered the pen’s initial writing. Hence, the ink that then fills the indentation is a “writing on top of writing” ( כתב ע"ג כתב ), which is not valid (neither in the case of a Get, nor in the case of a Sefer Torah).
Therefore, although Taz,8 concerning a Get, writes that when a reed or quill pen is not available it is permitted to use a metal-tipped pen, it is certainly preferable not to use such a pen.
Moreover, Aruch HaShulchan,9 concerning a Sefer Torah, writes that it is preferable not to use a metal-tipped pen, in the first place because it may puncture the parchment (see there for the issue involved), and because, just as in the case of an altar the Torah forbids using metal implements to fashion it because it is not proper that a substance usually employed to shorten life should be used on a structure that extends life,10 so too in the case of a Sefer Torah it is not proper to use metal-tipped pens to write it because a substance usually employed to shorten life should not be used to write the work that extends life ( "אורך ימים בימינה" ).
For this reason and other similar reasons, the Beis Din rules that the sofer did not fulfill the conditions of the contract and must therefore return the money he received to write the Sefer Torah.

Similarly, Tefillin that have worn out and a Sefer Torah that has worn out, one cannot make from them a Mezuzah, because we may not bring down from a more severe sanctity to a lesser sanctity.
Rashi: A Sefer Torah that has worn out - we may not cut the page in which are the paragraphs of Shema and VeHayah Im Shamoa to place them in a Mezuzah.
Shulchan Aruch1 rules in accordance with this Gemara. Teshuvos Chasam Sofer2 cites a rabbi who asks whether perhaps this is only the law in the case of a Sefer Torah that was kosher at some point. However, in the case of a Sefer Torah that is so full of mistakes that it cannot be read from in public, perhaps it may be permitted to cut out the pages with the paragraphs of Shema and VeHayah Im Shamoa and make a Mezuzah from these paragraphs?
Chasam Sofer responds, however, that when the Gemara states that a Sefer Torah that wore out cannot be made into a Mezuzah, the implication is that so much more is the case when a Sefer Torah has not worn out, and is merely full of mistakes - for, if in the case of a worn out Sefer Torah, that is beyond repair, the respective paragraphs may not be removed and used to craft a Mezuzah, how much more so in the case of a Sefer Torah that is merely full of mistakes, that can still be repaired and used to read in public.
Chasam Sofer adds, that although Teshuvos Rivash3 writes that a Sefer Torah that has mistakes is categorized as a Chumash, Rivash did not mean that a Sefer Torah with mistakes is on a lower level of sanctity than one that has not mistakes, but only that it may be sold and its money used for other purposes.4 Moreover, continues Chasam Sofer, even a Chumash (one of the five books of th Torah written independently) that is written on parchment and made as a scroll is of the same level of sanctity as a Sefer Torah - although it is not proper to read from it in public.
Maharal5 takes this a step further, and states that one may continue to read in public from a Sefer Torah which is missing letters or has extra letters, as its sanctity is the same as a Sefer Torah with no mistakes. He explains that although a Sefer Torah with mistakes has the status of a Chumash, in fact, even a Chumash is only ineligible for public reading because it is not proper to fulfill the congregation’s obligation to hear the Torah reading from a scroll that contains only a part of the Torah. In the case of a Sefer Torah that has some mistakes, however, the entire Torah is present in the scroll, and therefore it can be used to fulfill the congregation’s obligation.6
On the basis of these Poskim and other sources, Teshuvos Tzitz Eliezer7 rejects a certain essay that stated that some individuals attempt to refrain from accepting aliyos lest the Sefer Torah to which they are called contains mistakes. He concludes that therefore it is not mandatory to submit a Sefer Torah to a computer scan to ascertain whether it contains too few or too many letters, and that such practice is laudable, but not essential, so long as the Sefer Torah underwent a comprehensive check by a reliable Sofer.8

תפארת ישראל - פרק ס"ז: דאפילו בחומשין היו קורין אי לאו משום כבוד הצבור דלא בעינן לקריאה בצבור ספר תורה רק קריאת הפרשה ולפיכך הקריאה לא תליא בזה, וכדאמר רבי יוחנן ספר תורה שחסרה יריעה אחת אין קורין בה הא תיבות אף אם הרבה חסרים שפיר קורין בה. ולפיכך אם יש תוספת אותיות או תיבות בודאי מותר לקרות בה אפילו לכתחילה ומכל שכן שאין צריך להוציא אחרת, וכן אם חסר בה אותיות שבשביל אותו חסרון אין משתנה הקריאה כגון במלא ובחסר מותר לקרות בה דלא שייך לומר דאסור משום דברים שבכתב אי אתה רשאי לאומרם בעל פה דהא לא שייך בחסר אות שהיה צריך להיות מלא. אבל חסרון אותיות המקלקלין הקריאה בזה יש לאסור ולא משום שהיא ספר תורה פסולה אלא משום דברים שבכתב אי אתה רשאי לאומרם בעל פה, ולא שייך בזה כמו דאמ' ביומא (ע' ע"א) דמותר לקרות בעל פה ולא להוציא אחרת משום פגמו של ראשון דהכא לא שייך פגמו של ראשון כיון דקיימא לן דספר תורה פסולה היא, מכל מקום יראה דאותו חסר יקרא בחומש ואין צריך להוציא ספר תורה אחרת כלל ולא שייך כאן אין קורין בחומשין בשביל כבוד הצבור, דלא שייך לומר כך כיון שיש כאן ספר תורה הרי כבוד הצבור איכא רק שקורין תיבה אחת או שתים ואין זה ממעט כבוד הצבור כיון שכל הקריאה הוא בספר תורה רק תיבה אחת או שתים.

עיין בשו"ת ציץ אליעזר חלק יח סימן נז שכתב: ואם בכמה פריטים לא נהגינן כהכרעת המהר"ל מפראג בזה, אבל לדבר זה שיש קדושת ס"ת גמורה גם כשחסר בה אותיות או תיבות, בודאי ובודאי שההכרעה היא בכזאת. וכפי שמצאנו להנו"ב והח"ס ויתר הגדולים שס"ל ג"כ בכזאת וכנז"ל.
